RSM's Orly Taitz Presents Birth Certificate Case In 9th Circuit Court

Taitz and another Southern California lawyer seek the court's permission to press a lawsuit about President Barack Obama's birth certificate.

Two attorneys who remain unconvinced that President Barack Obama was born in the United States took their case to a Pasadena courtroom today, asking an appellate court panel to reinstate their lawsuit challenging his citizenship and asking for closer examination of his birth certificate.

U.S. District Judge David O. Carter in Santa Ana dismissed their case in 2009, ruling that the court was not the proper place to challenge a president's election—echoing a ruling by a federal judge in Georgia.

But attorneys Gary Kreep and Orly Taitz continued to press their case today—even though Obama released his Hawaiian birth certificate last week.

"The only recourse for the people is the courts," Kreep, who is based in Ramona, told the panel. "Nobody has been willing to take on Mr. Obama."

Taitz, of Rancho Santa Margarita, added, "Mr. Obama, the evidence shows, committed a fraud."

Assistant U.S. Attorney David DeJute insisted that the courts were not the proper venue to challenge the president, saying only Congress can do so through the impeachment process.

The panel heard about an hour of arguments, then took the matter under submission.

Kreep and Taitz have lost several legal efforts to disqualify the president from holding that office, and have faced sanctions for abusing the federal court system. Taitz was fined $20,000 by a judge in Georgia.

Taitz said today she was surprised by the treatment she has received from the courts and federal prosecutors.

"I come from the Soviet Union,'' she said. "I would expect that in the Soviet Union. I would not expect it here."

Although the original lawsuit sought release of the birth certificate, the pair now want a forensic expert to examine the birth certificate released by Obama last week.

Taitz has three separate court actions pending to challenge Obama's qualifications to serve as president. She told City News Service last week that she questions the birth certificate's authenticity because it lists the president's father's race as African, instead of negro.

Kreep and Taitz also challenge the president's citizenship because they believe he was adopted by a foster father while living in Indonesia as a child, according to the United States Justice Foundation. Kreep is the foundation's executive director.

Obama said last week he hoped that releasing the long-form birth certificate would help end the so-called "birther" movement.

"I know there's going to be a segment of people for which, no matter what we put out, this issue will not be put to rest," he said. "But I'm speaking to the vast majority of the American people, as well as the press—we do not have time for this kind of silliness. We've got better stuff to do. We've got big problems to solve. And I'm confident we can solve them, but we're going to have to focus on them, not on this."

The president also gently poked the birther movement at Saturday's White House Correspondent's Dinner.

The president said Donald Trump and other birthers were happy that the long-form birth certificate had been released, because it allowed them to investigate other questions like "Did we fake the moon landing? What really happened in Roswell? And where are (missing rappers) Biggie and Tupac?"

Sorry Pam, but you're wrong and it's obvious you don't know what you are talking about. OCR software does NOT create layers. Stop regurgitating the BS you are being told by rabid Obamabots. If you have PhotShop, Adobe, Illustrator or any other Adobe imaging software, try looking for yourself at the document and you will find many inconsistencies in it that expose it as a forgery, and a poor one at that. That is, if you even know what to look for, which from your post, I doubt.
I don't know how old you are, but if you had any clue, you would know that in 1961, the term "African American" had not yet been invented by politically correct types to describe "Black" and/or "Negro" Americans. It's sad that that so many Obama supporters have abandoned logic and common sense in defense of Dear Leader.

Jimmy, People will believe what they want to believe, regardless. I'm simply offering facts...
1) Taitz' complaint is that it says "African" not "African American". I am well aware of when use of the latter came into being, within my lifetime most certainly, which has nothing to do with this. 2) Her assertion is that the choice "African" was not available on the Census. I am simply letting you know, in the days before computers , this was irrelevant. There was no "choice" of what to put on there-it was up to the clerk. What would be more telling would be to pull multiple certificates by the same person for African Americans in Hawaii, & see what they say. 3) I have been working with computers since 1984, installing & programming. Short of using punch cards I'm about as technical as they get. I most certainly do know what I'm talking about when I discuss OCR scanning and layers. That was really in relation to another video, so perhaps you have not seen it, or if you have you are one who would look past the facts to defend it, anyway. Past that, I have to ask why on Earth people would spend so much effort if not for prejudice? For all our past white Presidents, who was asking if they were citizens? My grandma was white & her ancestors were from Germany. I'm just saying... so much going on in the world, surely we can spend our energy more constructively in moving forward. Yesterday's events really ought to put this more in perspective.

He ran with terrorists, withheld birth information that sent a war hero to prison, has 3 different last names, 39 social security numbers and addresses listed in the U.S., said he spent 2 years in Harvard when he really only spent 9 months, and thats just a few things we found out with him holding back all his records. There is no chance Obama is not eligible to be President. He's already provided TWO birth certificates, statements from TWO Hawaii governors (one Republican, one Democrat), statements of TWO Hawaii Department of Health Directors, and the State Registrar of Hawaii, plus TWO 1961 newspaper announcements of his birth gotten from the Health Department. Kapi'olani hospital published a letter from Obama saying he was born there in their publication and confirmed, on the air, that Obama was born there to a Denver talk show host just last week. What else do you want, a video tape of him being born?
You have your false rumor wrong. The story is that Obama spent 9 months at Columbia College rather than 2 years, not Harvard. But it's not true, whichever school you use. The college clearinghouse where Taitz violated their terms of use and snooped on Obama has two databases, one to confirm degrees and one to confirm attendance. She used the degree database, that only includes the graduation year info only -- hence 9 months. If you still have doubts about Obama's birth place after he released his long form, why do you think Terry Lakin would have been convinced? No, he would have disobeyed orders anyway, and gone to jail anyway. Birtherism is a chronic condition with no known cure.

******* Believe it or not, some people value the U.S. Constitution and would prefer to have a president that follows the rule of law re: natural born citizen. As for doing something more constructively, there's nothing I can think of that would be more constructive than to have BO exposed as ineligible in order to save the U.S.A. If the Constitution had been followed re: who is eligible to be POTUS, we would not have the destruction to our republic that we have.

I'm all for the Constitution, but the problem is the crazy rumors that some folks take as true in order to turn Obama into someone who isn't constitutionally eligible.
If you read the Constitution, you should see that it was followed exactly. We had this election, remember, and then the Electoral College voted, and the House of Representatives and the Senate in joint session and without objection certified the election of Barack Obama. He took the prescribed oath of office and he is President. That's how the Constitution works. Of course, you must be saying that you must be so much braver and smarter than the 535 members of Congress. If you really want to follow the Constitution, get to work on the next election. Nah, you're just a sore looser in denial.

Correction; you are offering OPINION. The "layers" issue is a red herring. There are so many reasons this document is fake, the layers could be ignored and it still doesn't stand up to the most basic forensic analysis. OCR is "Optical Character Recognition". It looks for shapes and patterns and attempts to translate them into text. OCR does NOT have the abilty to decipher elements or seperate the components of a scanned one-dimesional image and deliniate between modified or added components. With all due respect, "installing & programming" is a far cry from actual graphic development or image processing, which I have done professionally for more than fifteen years. A very basic look at the docuemnt in any Adobe imaging software reveals flaws so obvious, a first year graphic-arts student wouldn't have made them. There is no question as to whether or not this document is fake. It most assuredly is. The only real question is why would Obama release something so easily provable as a forgery? Stop pursuing this "layers" crap. It's false and anybody who actually uses the software knows it. As to your "argument" concerning "African" vs. "African American", all I can say is; "really?" They are one in the same and as such, NEITHER was used in 1961. Those people now reffered to as "African American" were at that time known commonly as "Black" and "Negro". The fact that you can ignore the Constitution is horrifying. No wonder the UOTUS was elected.

When Bush was in office, the libs and the press questioned EVERYTHING about the man; his college years, drug use, alcoholism, National guard records, his intentions, his intelligence, and so on, ad nauseam, ad infinitum. If he mispronounced a word, the media excoriated him for days. Now, when there are serious and legitimate questions about who is running the country, you SISSY DENIERS cry foul??? I have 160+ websites, they all have graphics on them, & I've been programming 27 years. Scanned OCR is separated in the document as text, & the rest are separate objects. You should know this. Unless you worked in the hospital in Hawaii in '61 you have no clue what they called African Americans. THAT is the point. This has nothing to do with ignoring the constitution. If I indeed thought that was happening, I'd be the first to cry foul. I have fought red tape & stupid rules my entire life. Making that statement is simply what the people who want to believe Obama is not a Citizen cry out, to intimidate people into backing off, & make them wrong. In fact, I believe it is anti American to continually criticize and harass people, just because he's not white. Again, what other President has been subjected to this? "All men are created EQUAL" - Thomas Jefferson, Declaration of Independence. But again, the real issue is, regardless of the facts I or others may present, you are determined to be right. You haven't presented any facts. It's all been your OPINION. Why don't you put together a video where you scan a "birth certificate" and show us all how you can create layers with text and separate objects? Then explain WHY IN THE WORLD anybody would do it that way, even if they could. The shortest distance between two points is a straight line. A layered PDF scan of a simple document is NOT a straight line. Put the crystals away and go back to your warm fuzzy land of Unicorns and Fairies, sprinkled with a little hypocrisy and racism. The rest of us live in the real world where truth, facts, words and reality mean something.

What is so very ironic about this is that Susan Daniels, Orly Taitz's crack investigator who reported all the Social Numbers (by scanning raw databases for anybody whose name was even close to "Barack Obama") stated once:
"when searching through database aggregators such as IRB, it is common to find a subject referenced with two or three Social Security Numbers (SSN)" I guess you get a lot more when in addition to Barack Obama, you add "Barakak Osama" and all those others in the list. There is no evidence that the real President Obama ever used any SSN except the one Orly, in violation of federal court rules and California state law, broadcast all over the Internet.

I think you insult the technical skills of high school students in your comment. If you ask a PDF expert, he will say that PDF creation software creates those layers when it optimizes scanned images. The conservative National Review magazine (among many others) has article explaining this. Heck, even the Obama-bashing-wheres-the-birth-certificate Bob Unruh at WorldNetDaily says the layers are created by the software automatically.
But the truth doesn't matter. Birthers can paste into their little paint set and see a layer, and that's all the need for proof that Obama is a commie-afro-bedwetting-criminal-traitor-muslim-sell-out-america-destroy-freedom usurper.

It doesn't matter who wrote the decision (and you have no way to know who that was). The judge, David O. Carter, is the one who put his name on it. Does Orly Taitz honor US Marine combat veteran Judge Carter for his service Vietnam? No, she publishes the following reader comment as an article on her web site:
"Good job, David. Such wickedness needs to be exposed when patriots like my son have died to preserve the very liberties people like Obama and Carter are selling off wholesale. The penalty for treason and traitors used to be the death penalty and, in England, the punishment meant being hanged, drawn and quartered"

I see she continues to violate California law and the court rules by failing to redact social security numbers. I just don't understand why Orly Taitz is allowed to get away with violation after violation, ignoring the California bar rules of professional conduct, flaunting California law, violating terms of use, and nobody except one judge in Georgia has had the gumption to hold her accountable. I know she's crazy, but crazy people have to follow the rules too.

Back in 2008 I was involved in an online political forum and I started seeing these messages about Barack Obama not being born in the US. Being one of those over-achievers, I did a not of research. I said, "could this be true?" I dug all the way down on every item. I tracked everything back to the primary sources. I probably have 3,000 hours in by now. What I found was the same thing everybody else finds that honestly looks: it's all crap. The problem with conspiracy theorists is that they live in a world of their own making. With a normal person, I could just say "read the article on FactCheck.org" (or PolitiFact.com, or the New York Times, or the Washington Post, or CNN or NPR...) and that would be it. But conspiracy theorists distrust all the normal news sources (those that actually check facts). Instead they rely on crank "experts" (e.g. Dr. Ron "Polarik") and get all their news from tabloids like WorldNetDaily, but more often from their own blogs. This is why conspiracy theories are not a delusion in the mental health sense, because within their own closed world of the conspiracy theory, their views are normal. Most birthers just parrot stuff of birther web sites, and never check anything for themselves. Others do check things, but they are so invested into the conspiracy story that they are unable to handle information objectively. I wish I had a cure -- I really do.

Maybe you can explain how Obama is qualified under the Constitution to be POTUS with a father from Kenya? Or explain his use of MULTIPLE Social Security Numbers? Or why he has spent about $2 Million dollars with Perkins and Coie to hide ALL of his records? That's just the tip of the iceberg. Of course, you'd better hurry-up with that tome as I think you have about two weeks before Corsi's book hits the streets. Doh!
The hilarious part of it is, you Obamabots don't give these legitimate questions a second glance, but you assail anybody with the slightest curiosity about any of it as "crazy". YOU are the ones with a mental illness. You can't even be honest about the situation - that reasonable people have questions that demand answers - substantial answers, not the "nothing to see hear, move along" crap we are being fed and you so eagerly lap up. Happily, this whole scam is quickly unraveling and more and more people are thinking for themselves and discovering the truth. I want to trust Obama's birth certificate copy published on April 27, 2011, but I have a couple of issues.
Why is there no similarity between Obama' August 4, 1961 birth certificate and the Nordyke twins' August 5, 1961 certificate, other than the Island, city, hospital and the certificate number? On Obama' August 4, 1961 birth certificate, why is number "4" in the certificate number, a lighter shade, than the others, considering all were inked from the same pad? Referring to Edith Coats' June 15, 1962 birth certificate, why is it that a year later, in the same hospital, on the same island and same city, both have the same "UK L Lee" Registrar? And you think I'm crazy? Jerome Corsi's upcoming book, that was #1 on Amazon.com has been plummeting ever since Obama released his long form. It's #97 at this moment. Birtherism has peaked. By the way, Corsi went to Kenya to research his first book, The Obama Nation. He interviewed Obama relatives. How come he never even hints that Obama was born in Kenya?

Why is Obama's birth certificate different from the Nordke certificate? Well, maybe because "Obama" and "Nordyke" are spelled differently? I don't see your point. You ask "why is the 4 lighter." Well if somebody were making a fake, all the numbers would be identical. Get out Microsoft Word and type some numbers and print them -- all the same. It's only a mechanical numbering machine that might have some variation from form to form. " Well duh, the guy didn't quit his job. The Hawaii Department of Health web site now links to the long form birth certificate on the White House web site. Orly needs to pick up her passport and head back home or back to the "looney farm" from which she came from!! What does it matter to Orly, who is not born in America herself! I truly believe Orly is laughing at how "DUMB DOWN" Americans can be! SAD how our first Black American President is betrayed as this due to people who are racist and just hateful! If we look back at the many Presidents we have put in office...how many were white and questioned or interrogated as to where they were born and there citizenship?
